As I said, protected speech cannot be punished by the government in any way. In the military, some speech is not protected. That is strictly related to contemptuous speech about the president or other officials and military command or speech which compromises mission effectiveness. That does not include YouTube influencer Charlie Kirk. Any other stupid questions?

Again, it is explicitly illegal for the government to punish you, in any way, for protected speech. Period. All of your opinions and ideas about how things should be, do not matter at all. You need to do your research on constitutionally protected rights.

If your morality means that you laugh when evil things happen to people, I don’t want you to have a gun in service of the country, I don’t trust you. Luckily what you want is completely irrelevant. Government/military personnel enjoy the same constitutional protections as everyone else. Private employers can dictate their own policy regarding workplace speech etiquette, because the 1st amendment only protects you from government retribution, not private employer. Obviously, the government is not a private employer, and they can be sued for wrongfully discharging someone if constitutional rights were violated. And we get to pay for that.

Look, I realize that the constitution is little more than used toilet paper stuck to Trumps ass at this point, but on paper the military still abides by the constitution. Government retribution for free speech is explicitly against the law. There are some exceptions for active military that apply to contemptuous speech of the President or other officials and military command, but those dont concern Charlie Kirk.

Your counter argument is posting AI summaries, which reiterated the same facts Ive already gone over? Thats really cute. Try explaining, in your own words, which of those neat little summaries applies to making fun of or speaking negatively about Charlie Kirk dying. I think the only thing we havent covered in there is speech made as part of their official duties. And yes, if a service member were to say, attend a government press conference, in uniform, and say on television The way Charlie Kirk leaned left on the gun issue after being shot really surprised me!, that wouldnt be protected. Posting it on their social media, would be.

And again, freedom of speech does not mean freedom from consequences. I can do this all day, I have no issue repeating myself 🙂 Freedom of speech literally means freedom from consequences from the government. The government cannot violate your constitutional 1st amendment right for protected speech. Morality has nothing to do with that. We have already gone over what isnt protected speech and none of it encompasses Charlie Kirk, no matter how sad his death was or how saintly you believe him to be. In America, you can express your opinions without reprisal from the government in any form. If the government violates your constitutional rights, you can successfully sue them. Its happened many times before, even for service members, and it will happen again when the government again violates the constitutional laws they must abide by. Military service members cannot be dismissed for morality reasons if it violates their constitutional rights. Constitutional rights come first. To help you understand your own point you are trying to make, that means if a service member does an act of immorality that goes beyond protected speech, such as lying with the intent to commit fraud or theft, that could be dismissible. However, saying wow, the look on Charlie Kirks undersized face when his neck erupted made me laugh uncontrollably, that would be protected 1st amendment speech that the government cannot legally in any way interfere with or reprimand you for.
