More likely hell get a good plea deal. Jury nullification is unrealistic but a hung jury isnt. Its going to be hard to get 12 jurors to unanimously convict. Its not something the prosecution wants to retry over and over. The public reaction means no matter how rock solid their case is, they will have to contend with the fact that most jury pools are going to have one or more sympathizers. Offering a good plea deal is their best bet at conviction. I just dont know how Luigi wants this to play out; he obviously wanted to get caught and planned to get caught, he may actually want a high profile jury trial to take place.
