Because it doesn’t pick apart anything. The context is they already had him sudued. His crime or lack thereof has nothing to do with the conduct after that point. This is, by the way, the law.

You know the LAW doesn’t care about the context when someone violates a different law, right? If you see someone run a red light, does that make it OK for you to rob a bank? Because that is the context you are asking for.
Poverty. That is the determining factor of being a criminal. You want to know why there are more fatherless homes in impoverished areas? Because of poverty. Because instead of helping people, we choose the most violent and destructive way of dealing with poverty; throw desperate people in prison with massive sentences.
